Terms and Conditions
Article 1 - Definitions
For the purposes of these terms and conditions:
- Withdrawal period: The period within which the consumer may exercise their right of withdrawal.
- Consumer: A natural person who is not acting in a professional or commercial capacity and who enters into a distance contractual relationship with the trader.
- Day: A calendar day.
- Long-term transaction: A distance contract relating to a series of products and/or services, with obligations spread over time.
- Durable medium: Any medium that enables the consumer or the trader to store information in a way that allows future reference and unchanged reproduction of the stored information.
- Trader: A natural or legal person offering products and/or services to consumers at a distance.
- Distance contract: A contract concluded without the consumer and trader being simultaneously present, using one or more means of distance communication.
- Means of distance communication: Any means used to conclude a contract without the consumer and trader being present in the same place.
- General conditions: These general terms and conditions of the trader.

Article 3 - Applicability
These general terms and conditions apply to every offer made by Benson & Harper London and any distance contract concluded between the trader and the consumer. Before a distance contract is concluded, the text of these general conditions will be made available to the consumer. If the contract is concluded electronically, the terms and conditions will be made available in such a way that the consumer can store and access them on a durable medium.
In the event of conflicting terms between the general terms and specific product or service conditions, the most favorable conditions for the consumer will apply.
Article 4 - The Offer
If an offer has a limited period of validity or is subject to conditions, this will be clearly stated. The offer contains a complete and accurate description of the products and/or services offered. Any images used are a true representation of the products or services. However, obvious mistakes or errors do not bind the trader.
Article 5 - The Contract
The contract is concluded when the consumer accepts the offer and complies with the conditions specified. If accepted electronically, the trader will immediately confirm receipt of the acceptance. If there is no confirmation, the consumer may cancel the contract. Benson & Harper London ensures a secure web environment for electronic data transmission and payments.
Article 6 - Right of Withdrawal
The consumer has the right to withdraw from the contract within 30 days without giving any reason. The withdrawal period begins the day after the product is received. During this period, the consumer must handle the product with care and only unpack it to assess whether to keep it. Withdrawal must be communicated in writing within 30 days of receipt.
The consumer must return the product in its original condition and packaging. The cost of returning the product will be borne by the consumer.
Article 7 - Refunds
In the event of withdrawal, Benson & Harper London will refund the payment as soon as possible, but no later than 30 days after receiving the product or proof of return. The refund will include the original shipping costs unless a more expensive delivery method was chosen by the consumer.
Article 8 - Exclusion of the Right of Withdrawal
Certain products and services may be excluded from the right of withdrawal if clearly stated in the offer.
Article 9 - Pricing
Prices will not be increased during the validity period of the offer, except for changes in VAT rates. Price increases after three months are permitted only if legally required or agreed in the contract.
Article 10 - Conformity and Warranty
Benson & Harper London guarantees that the products and services comply with the contract, legal requirements, and reasonable expectations. Any defects must be reported within 30 days of delivery. The warranty period corresponds to the manufacturer’s warranty and does not apply if the product has been repaired or damaged by the consumer.
Article 11 - Delivery and Execution
Orders will be delivered to the address provided by the consumer. Benson & Harper London will process orders within 30 days, unless otherwise agreed. In the event of a delay, the consumer has the right to cancel the contract without charge.
Article 12 - Duration and Termination of Contracts
Consumers may terminate open-ended contracts with a one-month notice period. For fixed-term contracts, consumers can terminate at the end of the renewal period with one month’s notice.
Article 13 - Payment
Consumers must make payments within 14 days unless otherwise agreed. For services, the payment period begins after receipt of the contract confirmation. Any discrepancies in payment details must be reported immediately.
Article 14 - Complaints Procedure
Complaints about the performance of the contract must be submitted within 14 days and described clearly. Benson & Harper London will respond to complaints within 30 days. If a complaint is justified, the trader may choose to replace or repair the product.
Article 15 - Disputes
Contracts between Benson & Harper London and consumers are governed by UK law. In the event of disputes, efforts will be made to resolve them amicably. If a resolution cannot be reached, disputes will be subject to the jurisdiction of the UK courts.
